1. Introduction
Kiakia Market Place Ltd("Kiakia", "we", "us", or "our") is committed to protecting personal data. This Privacy Policy describes how we collect, use, store, and share personal data when you use Kiakia Marketplace, including our website, mobile or web applications, and related services (the "Services"). It applies whether you are a buyer, seller, browser, or business contact.
Nigeria's Nigeria Data Protection Act 2023 ("NDPA") and related regulations and official guidance issued under it (collectively, "Data Protection Law") distinguish between controllers (who decide why and how data is processed) and processors(who process data on a controller's instructions). Where we decide how to use personal data in connection with Kiakia Marketplace, we act as a controller. Where we process data only on behalf of another organisation (for example certain enterprise integrations), that organisation is typically the controller and we act as a processor under their instructions.
We may update this Policy from time to time. We will post the revised version on the Platform and, where changes are material, use reasonable efforts to draw your attention to them. Continued use after the effective date means you accept the update.
2. Your privacy rights
Depending on Data Protection Law and the basis on which we process your data, you may have rights including:
- Access: request a copy of personal data we hold about you;
- Rectification: ask us to correct inaccurate or incomplete data (you can also update some details in your account settings);
- Erasure: ask us to delete data in certain situations (we may retain data where law or legitimate interests require);
- Restriction: ask us to limit processing in certain cases;
- Objection: object to processing based on legitimate interests, subject to exceptions;
- Automated decisions: where applicable, request human review of solely automated decisions with legal or similar significant effects;
- Data portability: where processing is based on consent or contract and is automated, request transfer of data you provided to you or another controller, where technically feasible;
- Withdraw consent: where we rely on consent, you may withdraw it at any time (this does not affect prior lawful processing);
- Complaint: lodge a complaint with the Nigerian Data Protection Commission ("NDPC") or other competent authority.

3. Who this applies to and age
The Services are not directed at children under 13. If you are 13 to 17, you may use buyer features only with a parent or guardian who agrees to this Policy and our Terms. Seller accounts and commercial contracts generally require you to be 18 or older. We do not knowingly collect personal data from children under 13 without appropriate parental authority.
By using the Services, you confirm that information you provide is accurate and that, where you act for a business, you have authority to share authorised representatives' data with us.
4. Personal data we collect
We may process:
- Identity and account data: name, email, phone, date of birth (where collected), photograph (optional), username, password hashes, seller verification or KYC documents where required;
- Transaction data: orders, basket history, delivery addresses, communications about orders, bids or offers;
- Financial data: masked payment details or references processed by payment partners; bank or payout details for sellers in line with onboarding;
- Location: address, state/LGA for classifieds or delivery, and approximate location derived from IP where relevant for fraud prevention or relevance;
- Usage and device data: log data, IP, device type, OS, app version, pages viewed, crash diagnostics, and cookies or similar technologies (see below);
- Communications: messages you send to support, sellers, or buyers through the Platform, call recordings where we give prior notice, and survey responses;
- User-generated content: reviews, ratings, photos of products, listings, and public Q&A;
- Marketing preferences: newsletter choices and similar opt-ins.
We may receive limited information from fraud-prevention services, logistics partners (tracking updates), or advertising and analytics partners as described when you use those features.
5. Cookies and similar technologies
We use cookies and similar tools to keep you signed in, remember preferences, understand traffic and app usage, measure campaigns, and improve security. Some cookies are essential; others (for example analytics or marketing) may be optional depending on your settings and applicable law. You can control cookies through your browser or device settings, but disabling certain cookies may limit functionality.
6. Lawful bases
We process personal data only where we have a lawful basis, such as:
- Consent: for example marketing emails or optional analytics where required;
- Contract: to provide the Services, process orders, and manage seller accounts;
- Legal obligation: for example tax, regulatory, or law-enforcement requests;
- Vital interests: rare situations involving safety;
- Legitimate interests: for example fraud prevention, IT security, improving the Platform, and measuring aggregated performance; balanced against your rights.
7. Vendors and processors
We use a structured process for sellers, payment gateways, logistics partners, hosting providers, and other vendors. Where they process personal data on our behalf, we require appropriate contracts (including data processing terms), restrictions on use, security measures, breach notification expectations, and cooperation with audits where necessary. Vendors who cannot meet our standards may be declined or offboarded.
8. How we use personal data
We use data to:
- Create and secure accounts and authenticate users;
- Facilitate listings, orders, payments, delivery, and returns;
- Provide customer support and resolve disputes;
- Detect, investigate, and prevent fraud, abuse, and illegal activity;
- Improve and personalise the Services, run analytics, and develop new features;
- Send service messages and, where permitted, marketing you can opt out of;
- Comply with law and respond to lawful requests;
- Enforce our Terms and protect rights and safety.
9. Sharing
We do not sell your personal data. We share data only as needed with: sellers and buyers (for example delivery details for fulfilment); payment and fraud partners; logistics providers; customer-support tools; IT and hosting providers; professional advisers; authorities when required by law; and corporate transaction counterparties (for example merger), with appropriate safeguards.
Third-party sites linked from Kiakia Marketplace have their own policies; we are not responsible for their practices.
10. International transfers
We may store or process data in Nigeria and on cloud infrastructure that may be located outside Nigeria (for example international hosting regions). Where Data Protection Law requires safeguards for transfers, we implement appropriate measures (such as approved contractual clauses or adequacy findings). By using the Services, you acknowledge that limited transfers may occur where necessary to operate the Platform securely and reliably.
11. Retention
We keep data while your account is active and for a reasonable period afterwards for legal, tax, audit, and dispute-resolution purposes. Retention periods may vary by data type; for example, support transcripts may be kept for a defined period to handle appeals. When data is no longer needed, we delete or anonymise it securely, subject to legal holds. Uninstalling an app does not automatically delete your account data; contact us to close your account if required.
12. Security
We use technical and organisational measures designed to protect personal data, including access controls, encryption in transit where appropriate, and monitoring. No online service is completely secure; please protect your credentials and devices.
13. Data breaches
If we become aware of a breach likely to affect your rights, we will investigate, mitigate and, where required by law, notify regulators and affected users without undue delay.
14. Marketing opt-out
You may opt out of marketing emails or SMS via unsubscribe links or by contacting privacy@kiakia.shop. Transactional messages about orders or security may still be sent.
15. Information about other people
If you give us data about someone else (for example a recipient or employee), you must have a lawful basis to do so and, where required, inform them and share this Policy.
